Former officer involved in fatal collision given suspended prison sentence

A former West Mercia Police officer who was involved in a fatal collision while responding to an emergency call has been given an eight months suspended prison sentence.

Police Constable Jamie Holloway, who resigned from the force after being found guilty of causing death by careless driving, was also ordered to complete 200 hours unpaid work,  pay costs and was disqualified from driving for 12 months.

Fifty-three-year-old David Shaw died following the road traffic collision in Worcestershire May 28, 2018.

West Mercia Police said the collision involved an unmarked police car travelling along the A449 from Worcester to Stourport-on-Severn, responding to an emergency call, and a car driven by Mr Shaw.

“Mr Shaw, who lived in Holt Heath, Worcestershire, suffered multiple injuries and tragically passed away on June 10, 2018,” it added.

Holloway was sentenced at Worcester Crown Court on Thursday (September 23) after being found guilty of the offence on August 18, following a trial into the death of Mr Shaw.

The jury found him not guilty of an original charge of causing death by dangerous driving.

Deputy Chief Constable Julian Moss said: “I hope today’s sentencing can offer Mr Shaw’s family and friends some form of closure and our thoughts remain with them at what continues to be an extremely difficult time.

“I can assure Mr Shaw’s family and communities across West Mercia Police that we take incidents such as these incredibly seriously and are committed to taking any learning from this case and embedding it within our organisation.”

West Mercia Police said the incident was referred to the Independent Office for Police Conduct, which carried out an independent investigation and referred the case to the Crown Prosecution Service for a charging decision. On Friday, May 22, 2020, Holloway was charged initially with causing death by dangerous driving.

“Holloway has resigned from West Mercia Police, however, an internal misconduct review will now take place,” it added.
